August 2024 Class Action Settlements Involve Costco, Bleacher Report, and 1-800-PACK-RAT

In August, 10 class action lawsuit settlements are accepting claims for various consumer issues such as call recordings, false advertising, data breaches and more.

New York UnitedHealthcare student health insurance refund

New York UnitedHealthcare established a refund program to compensate students who overpaid their premiums between 2019 and 2021.

The refund program benefits individuals who overpaid insurance premiums on their UnitedHealthcare Student Resources Insurance accounts due to incorrect rates used for certain 2019-20 and 2020-21 plan years.

Plaintiffs in the class action lawsuit say UnitedHealthcare used incorrect rates when charging students premiums for their Student Resources Insurance accounts. These inaccurate rates, applied to certain plan years between 2019 and 2021, allegedly caused significant overpayments students can now receive refunds for.

The deadline to submit a claim with the settlement is Aug. 6, 2024.

1-800-PACK-RAT call recording $1.6M class action settlement

1-800-PACK-RAT agreed to pay $1.6 million to resolve claims it recorded consumer calls without consent in violation of California laws.

The settlement benefits Californians who received one or more calls from 1-800-PACK-RAT’s customer service line between Sept. 27, 2021, and Oct. 10, 2022.

According to the class action lawsuit, 1-800-PACK-RAT failed to obtain consumer consent before recording customer service calls. This allegedly violated California’s call recording laws which require all parties to consent to recordings.

The deadline to submit a claim with the settlement is Aug. 7, 2024.

$2M Costco flushable wipes class action settlement

Costco agreed to pay $2 million to resolve claims its Kirkland flushable wipes damaged plumbing and septic systems.

The settlement benefits Costco customers who bought Kirkland Signature Moist Flushable Wipes in New York state between July 1, 2011, and May 31, 2017.

Plaintiffs in the false advertising class action lawsuit claim that, despite Costco’s promises the Kirkland wipes were flushable, these products caused serious damage when flushed. The wipes allegedly damaged pipes, septic systems, sewage lines and other plumbing.

The deadline to submit a claim with the settlement is Aug. 9, 2024.

Philips CPAP recall $494M class action settlement

Philips Respironics agreed to pay $494 million to resolve claims its now-recalled CPAP machines harmed consumers. 

The settlement benefits individuals who purchased, leased, rented, paid for or were prescribed a recalled Philips CPAP, Bi-Pap, ventilator or other recalled device.

Philips recalled many of its CPAP and respiratory devices in June 2021 over concerns the foam in these devices was defective and exposed users to dangerous chemicals. Plaintiffs in the class action lawsuit argue they were harmed by these defective products.

The deadline to submit a claim with the settlement is Aug. 9, 2024.

Atlantic General data breach $2.25M class action settlement

Atlantic General agreed to a $2.25 million settlement to resolve claims its subpar cybersecurity measures lead to a 2023 data breach.

The settlement benefits individuals who received a data breach notification from Atlantic General Hospital informing them their data may have been compromised in a January 2023 cyberattack.

The 2023 data breach allegedly compromised sensitive patient data such as Social Security numbers, health insurance information, financial account numbers and more. Plaintiffs in the data breach class action lawsuit claim Atlantic General could have prevented or mitigated the cyberattack by implementing reasonable cybersecurity measures.

The deadline to submit a claim with the settlement is Aug. 22, 2024.

East Palestine train derailment $600M class action settlement

Norfolk Southern agreed to pay $600 million to resolve claims one of its train cars derailed in East Palestine, Ohio, exposing residents to dangerous chemicals. 

The settlement benefits individuals and entities who lived, worked, owned property or operated a business within 20 miles of the East Palestine, Ohio, derailment site between Feb. 3, 2023, and April 26, 2024.

A Norfolk Southern freight train carrying hazardous chemicals derailed in East Palestine in February 2023. Plaintiffs in the class action lawsuit argue the derailment and subsequent controlled burn exposed them to dangerous chemicals that could have serious health consequences.

The deadline to submit a claim with the settlement is Aug. 22, 2024.

Bleacher Report VPPA $4.8M class action settlement

Bleacher Report agreed to a $4.8 million settlement to resolve claims it collected and shared user information with Facebook without consent.

The settlement benefits Bleacher Report users who had an account with the sports news website between Jan. 25, 2021, and May 21, 2024.

According to the class action lawsuit, Bleacher Report’s website utilizes Meta Pixel tracking that links user activity with Facebook accounts. Plaintiffs in the case argue this tracking was done without their consent and in violation of the federal Video Privacy Protection Act.

The deadline to submit a claim with the settlement is Aug. 23, 2024.

Newcourse Communications $600K class action settlement

Newcourse Communications agreed to pay $600,000 to resolve claims it failed to prevent a 2022 data breach.

The settlement benefits individuals who received a mailed data breach notification from Newcourse Communications in October 2022 and whose Social Security numbers were compromised in the 2022 data breach.

Plaintiffs in the data breach class action lawsuit claim Newcourse Communications failed to prevent a cyberattack in April and May of 2022 that targeted sensitive consumer information, such as Social Security numbers. In addition to failing to prevent the breach, Newcourse allegedly failed to inform consumers about the cyberattack until months later in October 2022.

The deadline to submit a claim with the settlement is Aug. 24, 2024.

CGM data breach $1.5M class action settlement

CGM agreed to a $1.5 million settlement to resolve claims its lax cybersecurity measures allowed hackers to steal sensitive data during a 2022 data breach.

The settlement benefits individuals who received a data breach notification from CGM informing them a December 2022 data breach may have compromised their information. 

According to the data breach class action lawsuit, CGM could have prevented the data breach by implementing reasonable cybersecurity measures. The plaintiffs argue hackers were able to steal sensitive consumer data due to the company’s alleged failures.

The deadline to submit a claim with the settlement is Aug. 26, 2024.

$6.49M CorrectCare data breach class action settlement

CorrectCare agreed to pay $6.49 million to resolve claims it failed to protect patients from a 2022 data breach.

The settlement benefits individuals whose information may have been compromised by the CorrectCare data breach discovered in July 2022 and announced in November 2022.

According to the data breach class action lawsuit, CorrectCare could have prevented the 2022 data breach by implementing reasonable cybersecurity measures. Because of CorrectCare’s alleged negligence, hackers were able to steal sensitive data gathered during medical claims processing, the plaintiffs contend.

The deadline to submit a claim with the settlement is Aug. 27, 2024.
